Acceptance of Terms
By accessing or using the SEND Consultants UK website and by engaging our services (together, the “Services”), you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use this website or engage our services.
Description of Services
SEND Consultants UK provides specialist SEND consultancy services to schools, academies, multi-academy trusts, and other educational settings across England. Our services include:
- SEND training and CPD programmes for school staff and leadership teams;
- strategic SEND reviews, EHCP compliance audits, and school consultancy;
- staff development and coaching for SENCOs and inclusion leads;
- Ofsted readiness support and inclusive practice advisory;
- related advisory, support, and guidance services as agreed with clients.
The scope, deliverables, and fee for each engagement are set out in a proposal or service agreement provided to the client prior to commencement.
Enquiries and Proposals
Submitting an enquiry through our website does not create a contract or obligation on either party. A binding agreement is only formed when both parties have agreed the scope of work in writing (whether by signed agreement, email confirmation, or accepted proposal).
Proposals and quotes are valid for 30 days from the date of issue unless otherwise stated.
Fees, Invoicing, and Payment
Fees for services are as set out in the agreed proposal or service agreement. Unless otherwise agreed in writing:
- invoices are payable within 30 days of the invoice date;
- invoices are issued by email to the contact address provided at point of engagement;
- we reserve the right to charge statutory interest on overdue amounts under the Late Payment of Commercial Debts (Interest) Act 1998;
- expenses agreed in advance (such as travel) will be invoiced at cost with supporting documentation available on request.
All fees are exclusive of VAT unless expressly stated otherwise. Where VAT is applicable it will be shown separately on invoices.
Cancellation and Rescheduling
Where a client cancels or reschedules a confirmed engagement, the following notice periods apply unless otherwise agreed in the service agreement:
- More than 14 days' notice: no cancellation charge.
- 8–14 days' notice: 50% of the agreed fee may be charged.
- Less than 7 days' notice: 100% of the agreed fee may be charged.
We will make reasonable efforts to reschedule where possible. Force majeure events affecting either party will be handled fairly on a case-by-case basis.
Client Responsibilities
To allow us to deliver services effectively, clients agree to:
- provide accurate and relevant information about the school's SEND context, needs, and goals;
- ensure appropriate staff are available and prepared for agreed sessions or reviews;
- provide access to documentation, policies, or systems reasonably required to perform the agreed work;
- not use our materials, reports, or recommendations in ways that misrepresent their scope or our findings.
Intellectual Property
All training materials, reports, frameworks, templates, and other resources developed and provided by SEND Consultants UK remain our intellectual property unless expressly agreed otherwise in writing.
We grant clients a non-exclusive licence to use materials provided as part of an engagement for internal use within the school or trust. Materials may not be resold, reproduced for commercial purposes, or shared externally without our written consent.
The content of this website, including text, branding, and layout, is owned by or licensed to SEND Consultants UK and may not be copied or commercially exploited without permission.
Confidentiality
Both parties agree to treat confidential information shared in the course of an engagement with appropriate discretion. This includes school-specific data, staffing matters, individual pupil information, and commercially sensitive details.
Where an engagement involves access to information about identifiable pupils, both parties will comply with their respective obligations under UK data protection law. We will not retain or process pupil-level personal data beyond what is strictly necessary for the agreed scope of work.
Disclaimers
Our services are provided by experienced education and SEND professionals and are designed to support schools in understanding and improving their SEND provision. However:
- our advice does not constitute legal advice and should not be treated as a substitute for independent legal counsel in matters of specific legal dispute;
- SEND legislation, the Code of Practice, and local authority practice can change — we will endeavour to keep our guidance current but cannot guarantee it reflects every recent development;
- outcomes from Ofsted inspections, EHCP decisions, or other processes cannot be guaranteed.
Our website content is provided for general information purposes. Except where required by law, our website is provided on an “as is” basis.
Limitation of Liability
To the extent permitted by law, SEND Consultants UK's total liability to a client in connection with any engagement shall not exceed the total fees paid by that client for the relevant engagement.
We are not liable for indirect, incidental, consequential, or special losses, including loss of profit, loss of data, or reputational damage, arising from use of our services or website.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud.
Acceptable Use of Website
When using this website, you agree not to:
- attempt unauthorised access to any part of our systems or infrastructure;
- transmit malicious code, conduct denial-of-service attacks, or interfere with normal operation;
- use automated tools to scrape, index, or copy website content without permission;
- use the website for unlawful, abusive, or fraudulent purposes.
Privacy
